1) HOW TO ENTER: Sweepstakes begins April 1, 2008 at Noon Eastern Time ("ET") and ends on May 31, 2009 at Noon ET (the "Promotion Period"). During the Promotion Period, complete and submit electronically the entry form located online at http://www.bicsweeps.com. Entrants must meet eligibility criteria, accurately complete entire online entry form and successfully submit same in order to be eligible for prize drawing; Limit one (1) entry per person per week for a maximum of sixty one (61) entries per eligible person for the entire Promotion Period. Any attempt by any person to enter in excess of the disclosed entry limit will void all their entries and any prize consideration in connection with this Sweepstakes. Information collected from entrants is governed by and subject to the Sponsor's Privacy Policy, available at http://www.bicsweeps.com. All entries become the property of the Sponsor (as defined below) and will not be returned. Incomplete or corrupted entries are void. Releases (as defined below) assume no responsibility for lost, stolen, late, mutilated, destroyed, delayed, falsified, incomprehensible, misdirected, undelivered, postage due, garbled, damaged, incomplete or illegible entries or mail; or for any electronic, computer, or telephonic malfunction or error, incorrect or inaccurate entry information; computer bugs or viruses; failures in servers or other connections; lost or interrupted or unavailable network, miscommunications, failed phone or hardware or software transmission failure or loss; delayed or corrupted data transmissions; garbled or jumbled transmissions or for any other error of any kind, whether computer, technical, printing, typographical, human or other, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the announcement of the prize, the processing of entries or in any Sweepstakes related materials.
2) WINNER SELECTION & NOTIFICATION: Potential winners will be selected in a random drawing on or about June 12, 2009 from among all eligible entries received during the Promotion Period under the supervision of Marden-Kane, Inc. (Administrator), an independent judging organization whose decisions are final on matters relating to this Sweepstakes. Odds of winning depend on the number of eligible entries received. Within five (5) days of the drawing, the potential winners will be notified by e-mail, overnight delivery service, and/or U.S. mail and may be mailed an Affidavit of Eligibility, a Liability Release and, where legal, a Publicity Release which must be executed and returned within 14 days following the date of issuance. Non-compliance with this time period, with these Official Rules or return of any e-mail, mail or prize notification as undeliverable, at Sponsor's discretion, may result in disqualification and selection of an alternate winner. If the potential winner is not of age of majority in his/her state of residence, the prize will be awarded in name of his/her parent or legal guardian, in which case the parent or legal guardian will be responsible for fulfilling all requirements imposed on winner set forth herein, including, but not limited to, executing and returning any required documents. All prizes will be awarded if properly claimed.
3) PRIZES: GRAND PRIZE (1): One (1) Grand Prize winner will receive one (1) Sony® BRAVIA® S-Series Digital LCD Television, one (1) Sony® VAIO® TX Series Notebook PC, one (1) Sony® Platinum DVD Dream® System, one (1) Sony® High Definition Digital Camcorder, one (1) Sony® Cyber-shot® Digital Still Camera and one (1) Sony® Digital Photo Printer. Approximate Retail Value ("ARV"): $10,200. FIRST PRIZES (3): Three (3) First Prize winners will receive one (1) Sony® VAIO® TX Series Notebook PC (ARV: $2,600). SECOND PRIZES (6): Six (6) Second Prize winners will receive one (1) Sony® Hard Disk Drive Camcorder - 40GB (ARV: $1,100). THIRD PRIZES (95): Ninety-five (95) Third Prize winners will receive one (1) Sony® Cyber-shot® Digital Still Camera (ARV: $280 each). Total ARV of all prizes: $51,200. Prizes are non-transferable; no substitutions or cash equivalents allowed, except at the sole discretion of the Sponsor, who reserves the right to substitute a prize of comparable or greater value. All details of prizes shall be determined solely by Sponsor. Model numbers for any prize are subject to change based on availability of the model at time of fulfillment. Prizes are awarded "as is" with no warranty or guarantee, either express or implied outside of manufacturer's limited warranty. Limit one (1) prize per person/household.
4) ELIGIBILITY: This Sweepstakes is open only to legal residents of the 50 United States & District of Columbia, who are eighteen (18) years of age or older and are residing in the 50 United States or the District of Columbia at the time of entry. Void outside the 50 United States & District of Columbia, in Puerto Rico and where prohibited by law. Employees of BIC USA Inc. ("Sponsor") and its parent company, divisions, affiliates, subsidiaries, advertising and promotion agencies and anyone working directly on BIC promotion programs, and the immediate family members (parent, spouse, child, sibling and their respective spouses) and persons living in the households of such persons, whether or not related, are not eligible to enter or win a prize.
5) GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these Official Rules and the decisions of the Sponsor and judges which are final and binding on all matters. The laws of the United States govern this Sweepstakes. All applicable federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. All federal, state and local taxes, and other charges, if any, are the sole responsibility of the winner. An IRS Form 1099-MISC will be issued for prizes that are valued at $600 or more. Acceptance of prize constitutes permission for Sponsor and its designees to use winner's name and likeness for advertising and promotional purposes in any and all media now or hereafter known worldwide in perpetuity without additional compensation, notification or permission, unless prohibited by law. By entering, participants agree to release and hold harmless Sponsor, MKTG.partners, Marden-Kane Inc. and their respective parent companies, divisions, affiliates, subsidiaries, retailers, advertising and promotion agencies, and each of their respective directors, officers, employees, shareholders and agents (collectively "Releases") from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes or acceptance or use of prize. Sponsor, MKTG.partners, and Marden-Kane, Inc. are not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive visit information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes or any element thereof. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the http://www.bicsweeps.com website. Sponsor may conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the date of action requiring such termination. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed 'void' by the judges. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
6) WINNERS LIST: To receive the names of the winners (available after June 21, 2009), please mail a self addressed stamped envelope to: BIC Winners, c/o Marden-Kane Inc., 36 Maple Place, Manhasset, NY 11030. Requests received after July 31, 2009 will not be fulfilled.
